Notice of Public Hearing concerning consideration of renewal of waste discharge requirements and consideration of issuance of a cease and desist order. I will file for acceptance as a disgnated person as Michael M. Miller an individual. If you ever had anything to say or any thoughts about having an audience with a state board, here is your chance to get the opportunity to speak.

SIXTEEN TO ONE MINE
The Original Sixteen to One Mine, Inc. owns and operates Sixteen to One Mine, a hard rock mine in the town of Alleghany, Sierra County. Ore is processed, or milled, on site. Wastewater, sand, and sediment from the milling process are discharged to series of settling basins on the ground surface. Clarified wastewater is discharged from the surface settling basins to other settling basins underground in the mine, where it commingles with drainage in the mine. The commingled wastewater is discharged to Kanaka Creek, which is tributary to the Middle Yuba River, Yuba River, Feather River, and the Sacramento River. The average daily dry weather flow is O.2S million gallons per day. The discharged waste and wastewater have violated limitations and requirements of the existing Waste Discharge Requirements (WDRs). The proposed WDRs contain more stringent limitations and requirements. Due to the violations of the existing WDRs, a Cease and Desist Order (C&D) is proposed. The proposed WDRs and C&D include schedules for compliance with the existing and proposed limitations and requirements.
A formal public hearing concerning this matter will be held during the Regional Board meeting, which is scheduled for:

The designated parties for this hearing are as follows:

• Staff of Original Sixteen to One Mine, Inc.
Only designated parties will have these rights: to call and examine witnesses; to introduce exhibits; to cross-examine opposing witnesses; to impeach any witness; and to rebut the evidence against him or her. All other persons wishing to testify or provide comments are interested persons and not designated parties. Such interested persons may request status as a designated party for purposes of this hearing by submitting such request in writing to the Board no later than 19 February 2002. The request must explain the basis for status as a designated party and in particular how the person is directly affected by the discharge.
Persons wishing to comment on this noticed hearing item must submit such comments in writing to the Regional Board no later than 19 February 2002. Written testimony or comments submitted after 19 February 2002 will not be accepted and will not be incorporated into the administrative record if doing so would prejudice any party.
All interested persons may speak at the Board meeting, and are expected to orally summarize their written submittals. Oral testimony will be limited in time by the Board Chair
